Maine Just Made Mold a Habitability Issue — and the State's Own Website Hasn't Caught Up

A law that took effect July 29, 2026 adds mold to the implied warranty of habitability. Most published summaries still show the old text.

When we swept all 51 U.S. jurisdictions for recent changes to mold-related law, Maine stood out — not because the change was large, but because of how fresh it was and how few sources reflected it.

Public Law 2025, chapter 515 added mold to Maine's implied warranty of fitness for human habitation. It became law without the governor's signature and took effect on July 29, 2026. At the time we checked, Maine's own official statute pages still displayed the pre-amendment text.

Why this matters for renters

Before this change, a Maine tenant dealing with mold had to route the claim through general habitability language. Now the statute names it. That is a materially stronger footing for a tenant asking a landlord to act — and a clearer duty for landlords.

The larger lesson
